First Bank of Alabama Electronic Signatures and Communications (E-Sign) Agreement

 

By accepting the “First Bank of Alabama’s Electronic Signatures and Communications (E-Sign) Agreement”, you consent and agree that the First Bank of Alabama may provide certain disclosures and notices to you in electronic form, in lieu of paper form. Your consent permits the general use of electronic communications, delivery of documents, and electronic signatures in connection with your First Bank of Alabama accounts that are accessible in First Bank of Alabama Online and Mobile Banking platforms. Please read this agreement carefully and print or download a copy for your files.

The words “we,” “us,” and “our” refer to the First Bank of Alabama, and the words “you” and “your” mean you, the individual(s) or entity identified on the Account(s). As used in the Disclosure, “Account” means the account you have with us. “Communication” means any customer agreements or amendments thereto, monthly billing or account statements, tax statements, disclosures, notices, responses to claims, transaction history, privacy policies and all other information related to the product, service, or account, including but not limited to information that we are required by law to provide to you in writing. Online products and services include but are not limited to online banking, mobile banking, mobile apps, bill payment, internal and external transfers, mobile check deposit, and other digital services including future enhancements and services.

Communications Provided in Electronic Form

  • You agree that we may provide you with any communication that we may choose to make available in electronic format, to the extent allowed by law, and that we may discontinue sending paper communication, unless and until you withdraw your consent as described in the withdrawal on consent section below.
  • Your consent to receive electronic communications and transactions includes, but is not limited to:

All legal and regulatory disclosures, agreements, and communications associated with your account, product, or service.

Notices or disclosures about a change in the terms or change in fees of your account.

Privacy policies and notices.

Notices regarding deposit, loan, and certificate of deposits.

Monthly (or other periodic) billing or account statements for your account.

All other communications or information related to your account that we are required to provide in writing in connection with our relationship with you.

Method of Providing Communications in Electronic Form

Electronic Communications by the First Bank of Alabama (including alerts that communications have been provided or posted) will be sent by one or more of the following methods:

  • By email to you at the email address you have provided to us. Such emails may include the communication as an attachment, notice that your communication is available in First Bank of Alabama online banking or our mobile application, or as an embedded link to a website that we operate and control.
  • By accessing any online product or service.
  • By a notice that is contained within your electronic statement.
  • By electronic messaging (such as SMS text or push notifications to your mobile device).
  • By accessing a web site that we will designate in the notice we send to you via email or electronic messaging, or that we designate in advance for such purpose.
Note:
  • At our option, we may treat your provision of an invalid email address, or the subsequent malfunction of a previously valid email address, as a withdrawal of your consent to receive electronic Communications.
  • First Bank of Alabama will not impose any fee to process the withdrawal of your consent to receive electronic communications.

How to Request Paper Copies

  • You can obtain a paper copy of an electronic communication by printing it yourself, or by requesting communication in paper format to be mailed to you within a reasonable timeframe after first dispersed.
  • To request a mailed paper copy, please call (256) 362-2334 or contact your account officer at the nearest First Bank of Alabama branch.
  • The Bank may charge you a reasonable fee for requested mailed copies. Please refer to the most recent fee schedule and account disclosure provided to you by First Bank of Alabama or contact the bank at 256-362-2334 for this information.
  • The Bank reserves the right, but assumes no obligation, to provide a paper (instead of electronic) copy of any communication that you have authorized us to provide electronically.

Updating Your Records

  • You can update your contact information (email address for electronic communications, mailing address and phone number) in Online Banking or Mobile Banking, by calling (256) 362-2334, or by contacting your account officer at the nearest First Bank of Alabama branch.

To update your contact information in Online Banking: Sign in to Online Banking, click your profile circle icon with your initials at the top right corner of the dashboard, click settings, click edit on the field you wish to update, enter your online banking password and click confirm, input changes then save.

To update your contact information in Mobile Banking: Sign in to the Mobile App, click your profile circle icon with your initials at the top right corner of the dashboard, click edit on the field you wish to update, enter your password and click submit, input changes then save.

  • It is the customer’s responsibility to provide the First Bank of Alabama with an accurate and complete email address and contact information.
  • It is the customer’s responsibility to maintain and promptly update any changes to your email or other contact information.
  • In the event email is returned undeliverable, communication documents and notices will be sent to the physical address on file at the Bank.

Hardware and Software Requirements

To Participate in Online Banking and to access, view, and retain electronic Communications your system will need the following requirements:

  • Sufficient electronic storage capacity on your computer’s hard drive or other data storage unit.
  • A current working and valid email account and email address.
  • A current version (*defined below) of a supported Internet browser, such as Safari, Chrome, or Edge.
  • A connection to the Internet.
  • A current version of a program that accurately reads and displays PDF files.
  • A computer or other device and operating system capable of supporting all of the above. You will also need a printer if you wish to print out and retain communications on paper and electronic storage if you wish to retain communications in electronic form.

*By "current version," we mean a version of the software that is currently being supported by its publisher. We reserve the right to discontinue support of a current version of software if, in our sole opinion, it suffers from a security flaw or other flaw that makes it unsuitable for use.

Note: First Bank of Alabama is not responsible for any electronic virus or viruses a customer may encounter. It is the Banks recommendation for the customer to perform routine scans for your PC by using a virus protection product. We may revise hardware and software requirements, and if there is a material chance that the changes may impact your ability to receive electronic communications, we will notify you. You would then be required to re-consent to start receiving electronic communications again.

By accepting this agreement, you certify that you have all the necessary hardware and software for you to receive electronic communications on your devices.

Communications in Writing

  • All Communications in either electronic or paper format from the Bank to you will be considered “in writing”.

How to Withdraw Consent of Electronic Communications

  • You may withdraw your consent to receive communications in electronic form at any time by withdrawing consent in Online Banking or Mobile Banking using instructions below:

Sign in to Online Banking or Mobile Banking, click your account, click eStatements, click sign up/changes, uncheck the checkmark by accounts you no longer wish to allow electronic communication for, click save settings.

  • Any withdrawal of your consent to receive electronic communications will be effective after a reasonable period of time to process your withdrawal.
  • First Bank of Alabama will not impose any fee to process the withdrawal of your consent to receive electronic communications.
  • After withdrawal of consent of electronic communications, you will begin receiving paper copies for all communications. Accounts that provide only e-statements will be switched to accounts that offer paper statements. There could be a fee associated with the reinstatement of paper statements. Any fees for receiving paper statements instead of electronic statements will be disclosed in the most recent account disclosure and fee schedule provided to you by the bank or you may contact the bank for this information at (256) 362-2334. You must re-consent electronically in Online Banking if you withdraw consent because of any reason to begin receiving E-Statements and other communication in electronic form again.

Termination / Changes

  • First Bank of Alabama reserves the right, in sole discretion, to discontinue the provision of your electronic Communications, or to terminate or change the terms and conditions on which we provide electronic Communications. The Bank will provide you with notice of any such termination or change as required by law.
  • It may be necessary to change the terms or conditions regarding your statement access. In such an event, the Bank will notify you via email communications or written notification.

Federal Law / Electronic Communications

By clicking the I Agree tab, you acknowledge and agree that your consent to electronic communications is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act, and that you and the Bank both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means. You certify that you have read this agreement and agree to all terms. Print or save this agreement for future reference.
